1: Collection of information
KLB systems Pty Ltd collects personal information
in the following ways:
- directly from you when you provide information
by phone or in documents such as an application
form (on-line or off-line)
- from our own records of how you use our
services
Principle 2: Use
of information
Your personal information may be used in order
to:
- provide the services you request
- manage and administer services you request
- improve the services you request
- develop and research our services
Principle 3: Disclosure
of information
The organisations to which KLB systems Pty Ltd
MAY disclose information include:
- your representatives (e.g., your authorised
representatives or legal advisers)
- government and regulatory authorities and
other organisations, as required or authorised
by law
- fraud-checking and credit reporting agencies
- agencies for credit related purposes such
as creditworthiness, credit rating, credit
provision and financing
- KLB systems Pty Ltd's professional advisers,
including accountants, lawyers and auditors
- suppliers and their immediate dispatch
and supply chains where it is required to
reasonably provide the services you have
requested, or a lawful requirement to pass
on the information
Your information will not be sold by KLB systems
Pty Ltd to external organisations for the purposes
of marketing or other unsolicited contact unless:
- not doing so conflicts with one of the
above disclosure directives or
- KLB systems Pty Ltd have written permission
from you
Principle 4: Data
quality
Prior to the use and disclosure of personal
information, reasonable steps will be taken
to ensure that personal information is relevant,
accurate, complete and up to date. It is possible
that KLB systems Pty Ltd or an agent of KLB
systems Pty Ltd will contact you to confirm
the validity of your on-file details.
Principle 5: Data
security
KLB systems Pty Ltd employ reasonable, current
measures to ensure that your details (both
electronic and physical) remain secure and
safe.
Physical measures include locks and alarms
on areas containing the physical data and computers.
Electronic measures include passwords on
computers and firewall security.
Principle 6: Access
KLB systems Pty Ltd will provide the personal
details held about you, to you on written request
EXCEPT where:
- providing access would pose a threat to
the life or health of a person or
- providing access would have an unreasonable
impact upon the privacy of other individuals
or
- the request is frivolous or
- the information relates to existing legal
dispute resolution proceedings between KLB
systems Pty Ltd and the entity about who
the data relates, and the information would
not be accessible by the process of discovery
in those proceedings or
- providing access would reveal the intentions
of KLB systems Pty Ltd in relation to negotiations
with the individual in such a way as to prejudice
those negotiations or
- providing access would be unlawful or
- denying access is specifically authorised
by law or
- providing access would be likely to prejudice
an investigation of possible unlawful activity
or
- providing access would be likely to prejudice:
- the prevention, detection, investigation,
prosecution or punishment of
- criminal offences; or
- breaches of a law imposing a penalty
or sanction or
- the enforcement of laws relating to
the confiscation of the proceeds of crime;
- the protection of the public revenue;
- the prevention, detection, investigation
or remedying of Seriously Improper Conduct;
or
- preparation for, or conduct of, proceedings
before any court or tribunal, or implementation
of its orders; by or on behalf of an
enforcement agency; or
- any agency performing a lawful national
security function asks KLB systems Pty Ltd
not to provide access on the basis that providing
access would be likely to cause damage to
the national security of Australia.
If access to personal information is reasonably
denied by KLB systems Pty Ltd based on the
above or similar criteria, independent legal
counsel may be sought at your expense. If KLB
systems Pty Ltd levies charges for providing
access to personal information, those charges:
- will be reasonable and
- will not apply to the actual request for
access
Further, KLB systems Pty Ltd will post any
changes in its stance on privacy in future
versions of this document.
Principle 7: Anonymity
Whenever it is practicable, you will have the
option of remaining anonymous when dealing
with KLB systems Pty Ltd.
Principle 8: Sensitive
information
KLB systems Pty Ltd will not collect personal
information revealing racial or ethnic origin,
political opinions, religious or philosophical
beliefs, trade union membership, or details
of health, disability or sexual activity or
orientation unless:
- the subject of the information has consented;
or
- the collection is required or specifically
authorised by law; or
- the collection is necessary to prevent
or lessen a serious and imminent threat to
the life or health of any individual, where
the subject of the information is physically
or legally incapable of giving consent; or
- the collection is necessary for the establishment,
exercise or defense of a legal claim.
Principle 9: Compliance
audit
KLB systems Pty Ltd convenes a panel to consider
any initiative that will require the collection
of personal data. The panel ensures that any
request for data complies with the principles
and rules outlined here, and is necessary for
the reasonable running and development of KLB
systems Pty Ltd. |
